TERMS & CONDITIONS PARTNER PRODUCER GHOSTPRODUCER.COM.BR
- OBJECT:
1.1 This contract (“Agreement”) establishes the terms and conditions between the music producer (“Partner Producer”) and GhostProducer.com.br (“Platform”) for the sale of music.
- ACCEPTANCE OF TERMS:
2.1 By uploading their music to the platform, the Producer Partner agrees to be bound by this Agreement.
- COMMISSION AND PAYMENT:
3.1 The Platform will receive a commission of 30% on the total value of each sale.
3.2 The Partner Producer will receive the net value of the sale after payment fee discounts (PayPal, Stripe, Mercado Pago).
- SALE AND TRANSFER RIGHTS:
4.1 By agreeing to this Agreement, the Producer Partner grants GhostProducer.com.br the right to sell and transfer the music to the purchasing customer.
4.2 The Producer Partner agrees not to distribute the music on other platforms during the term of this Agreement.
- FILES AND FORMATS:
5.1 The Partner Producer will provide main files, including MASTER version, MIXED VERSION, RADIO VERSION and STEMS/MULTITRACK, in addition to project and MIDI files.
- PROMOTION AND DISCLOSURE:
6.1 The Platform reserves the right to promote and publicize the Partner Producer's songs on its marketing channels.
- PLATFORM RESPONSIBILITIES:
7.1 The Platform will take reasonable measures to protect files and data provided by the Partner Producer against unauthorized access.
- UPDATES AND CHANGES:
8.1 Changes to the terms will only be valid if agreed in writing by both parties.
- TERMINATION.
9.1 Both parties have the right to terminate this Agreement for material breach of terms.
- APPLICABLE LAW AND JURISDICTION:
10.1 This Agreement will be governed by Brazilian laws, with exclusive jurisdiction of the courts of the state of São Paulo.
- INTERPRETATION:
11.1 In case of conflict, reasonable interpretation will be favored. Invalid clauses will be modified to keep the remainder of the Agreement in force.
- DIGITAL FLEXIBILITY:
12.1 In a constantly evolving digital environment, both parties agree to adapt terms to reflect technological and commercial changes, maintaining the essence of the partnership.
By agreeing to this Agreement, both parties acknowledge having read, understood and accepted its terms and conditions.
